This Price List cancels and replaces all previous versions. By placing an order, the Customer fully accepts the conditions set forth below, and their acceptance constitutes the basis of commercial negotiations. Sales are considered finalized only after express acceptance by Fima Carlo Frattini (hereinafter also “seller”).
PRICES
The prices in this Price List are exclusive of VAT and are expressed in euros. This Price List cancels and replaces all previous versions, except for errors or omissions. Any errors in this Price List cannot constitute grounds for dispute. By placing an order, the buyer fully accepts these Conditions of Sale. The selling company reserves the right to modify prices, general conditions of sale, and the products themselves at any time at its sole discretion and without prior notice. Our direct and indirect offers are without obligation, and sales are considered finalized only after express approval.
PRICE LISTS AND PRODUCTS
All information and prices included in catalogs, price lists, and any other printed material are provided for informational purposes only and do not constitute an obligation of faithful execution by the selling company. FIMA Carlo Frattini reserves the right to unilaterally modify the characteristics of the products sold without prior notice, without any obligation to modify or replace products previously supplied or currently ordered.
The images of our products contained in our catalogs, brochures, or any other promotional material are merely indicative representations of the individual items and do not constitute a commitment to their faithful production. The details, measurements, and weights cited are to be considered indicative.
ORDERS
Orders are subject to acceptance by FIMA Carlo Frattini and are tacitly subject to these conditions of sale. Orders or modifications must always be confirmed in writing by the Customer, even if anticipated verbally or by telephone. Unilateral cancellation by the buyer is never permitted without the prior written consent of FIMA Carlo Frattini, which reserves the right to refuse the total or partial cancellation of pending orders.
SHIPPING AND DELIVERY TERMS
The delivery terms indicated during order acceptance are non-peremptory and non-binding for the seller and cannot constitute a basis for a request for reimbursement and/or damages by the buyer. Failure to comply with the indicated delivery terms does not constitute the right to suspend and/or delay the agreed payment terms. Unless otherwise specified and confirmed in writing, shipments are always made to the address indicated during the order. Regardless of the agreements regarding shipping methods, all risks and hazards are transferred to the customer upon delivery of the goods to the first carrier, even if shipment is carriage paid. These conditions also apply in the event of natural disasters or force majeure. The customer is required to inspect and inspect the goods upon receipt and to promptly notify the carrier by registered mail in the event of tampering or damage to the packaging. Shipping costs, unless otherwise agreed in writing, are always the responsibility of the buyer.
CUSTOMER IDENTIFICATION DATA
The customer is responsible for all identification data provided at the time of ordering: Company Name, Registered Office, Tax Code, VAT Number, and any other information specifically required by applicable legislation. Customer data, in accordance with Legislative Decree 196/2003, will be stored and processed to fulfill legal obligations, and any other use must be expressly accepted by the customer.
PAYMENT AND RETENTION OF TITLE
The payment methods indicated on the invoice are mandatory: any changes not previously and expressly confirmed will not be accepted. Late payment will result in bank interest being charged from the day following the due date. In the event of non-payment within the agreed terms, all orders in the portfolio will be suspended without notice and deemed cancelled due to the buyer’s fault, without prejudice to compensation for damages. Payment for products already delivered will not be subject to order completion. No payment may be deferred in the event of disputes. Goods delivered to the buyer remain the property of FIMA Carlo Frattini until full payment of the agreed amounts has been made.
COMPLAINTS AND WARRANTY
All FIMA Carlo Frattini products are subject to a warranty under the conditions set forth in the “General Warranty Conditions” document. Damage caused by improper installation or misuse is never covered by the warranty. Returns of goods are not accepted unless authorized. In the event of proven product defects by FIMA Carlo Frattini, the warranty covers only the repair or replacement of the products without any further compensation for direct or indirect damages caused by use of the products.
Complaints must be made within 8 days of the sale of the goods to the end customer, by written communication and according to the methods set forth in the General Warranty Conditions. Return shipping costs are always borne by the customer unless otherwise agreed in writing by the sales department.
COMPLAINTS, RETURNS AND JURISDICTION
In the event of disputes, the Court of Novara will have jurisdiction.
FIMA Carlo Frattini offers the end consumer, in accordance with the terms and conditions set forth below, a 7-year warranty for all products supplied to the end customer under the FIMA Carlo Frattini brand.
FIMA Carlo Frattini guarantees that its products are free from defects in function, material, workmanship, and design.
Any defects that may arise will be repaired by FIMA Carlo Frattini at its own expense through repair or delivery of new products at its sole discretion.
The technical standards in effect at the time of product manufacture will be used as a reference for assessing the defect level of a product.
Following replacement, ownership of the defective product will pass to FIMA Carlo Frattini.
FIMA Carlo Frattini guarantees its products for a period of seven years from the date of purchase of the product by the end customer.
The warranty period will not be extended or re-started following the replacement and/or repair of the product or parts thereof.
Claims for repair or replacement may only be made if the product has been correctly installed, assembled, and used.
The instructions for use and assembly included in the box or on the fimacf.com website must always be followed, even during installation.
This also applies if the installation is performed by a specialized installer.
For this warranty to be valid, the product must be properly and adequately cleaned, maintained in accordance with the maintenance instructions, and used in accordance with the instructions for use.
FIMA Carlo Frattini products are individually subjected to rigorous visual and functional checks before and during packaging. Therefore, FIMA Carlo Frattini
waives its warranty in the following cases.

WARRANTY ACTIVATION
To activate the warranty, you must contact the supplier (plumber, wholesaler, or retailer) directly, who will be able to advise you on the procedure to follow. A warranty replacement request can only be made by presenting a dated document proving the purchase of the product.

Each return authorization will be identified with a reference number.
All authorized products must be returned at the sender’s expense no later than 15 days from the authorization date.

FIMA Carlo Frattini will examine each individual case and assess whether the conditions for the applicability of this warranty exist, reserving the right to deny repair or replacement if there are reasons for exclusion.
If the defects declared in the RMA form are not found, the customer will be notified, and the products will remain available for 30 days from the date of notification. After the 30-day period, the products will be scrapped.
Shipping costs for returning the defective product will be charged to the customer.
This warranty applies only to the extent explicitly stated above and subject to compliance with the aforementioned requirements.
